Event Liability Waiver

Event hosts sign this alongside the catering contract. For public-facing events (farmers markets, festivals), we use signage notifying guests of ingredient allergens rather than individual waivers.

Acknowledgment

I, the undersigned ("Host"), have contracted with Freeze and Fizz LLC ("Caterer") to provide beverage catering services at an event I am hosting. I acknowledge and agree to the following:

1. Nature of service

Caterer operates a mobile trailer that serves dirty sodas, shaved ice, lotus energy add-ons, and lemonades. These beverages contain sugar, caffeine (when Lotus or Red Bull is added), dairy, coconut, and various flavoring syrups that may contain soy, tree nut traces, or other common allergens.

2. Allergens & ingredients

I understand Caterer does not operate an allergen-free kitchen. I will (a) post ingredient information where guests can see it, and (b) inform guests with allergies to check with staff before ordering. I release Caterer from liability for allergic reactions unless caused by Caterer's gross negligence.

3. Caffeine warning

Lotus Energy add-ons contain approximately 120–160 mg of caffeine per serving. Caterer reserves the right to decline service to anyone appearing to be under 12, pregnant, or otherwise advised not to consume caffeine.

4. Slip and spill risk

Cold drinks create condensation, spills, and slip hazards. Host is responsible for monitoring the service area, placing appropriate signage, and maintaining safe guest flow.

5. Setup area & safety

Host has provided a setup area that is level, accessible, and free of hazards. Host is responsible for ensuring power sources (if used), extension cords, and generators are safely placed. Host acknowledges Caterer will not operate in lightning, severe wind, or other unsafe weather.

6. Alcohol & outside additions

Caterer does NOT serve alcohol. If guests add alcohol or other substances to drinks after receipt, Caterer bears no responsibility. Host is responsible for venue alcohol policy compliance.

7. Photography

Caterer may photograph drinks, setup, and anonymous crowd shots for marketing. Host agrees to inform any guest who wishes to opt out of photography. Check here to opt out entirely: ☐ Initial: _______.

8. Release and hold harmless

To the maximum extent permitted by Illinois law, Host releases and holds harmless Freeze and Fizz LLC, its members, employees, and agents from any claim, demand, or cause of action arising from the event, except for claims arising from Caterer's gross negligence or willful misconduct. This includes claims by Host's guests; Host agrees to indemnify Caterer from any guest-initiated claim relating to the event.

9. Force majeure

Caterer is not liable for failure to perform due to causes outside its reasonable control (weather, government action, equipment failure beyond maintenance, pandemic restrictions, etc.). See the Cancellation & Weather Policy.

10. Governing law

This waiver is governed by Illinois law. Jurisdiction: McLean County, IL.

11. Acknowledgment & signature

I have read this waiver, understand it, and am signing it voluntarily. If I am signing on behalf of an organization (school, corporate entity, etc.), I have authority to bind that organization.

Legal note for Frost/Mike: This waiver is a working template. For Illinois, pre-event signed liability waivers are generally enforceable but have limits — they cannot waive liability for gross negligence or willful misconduct. Before first use at a wedding/large event, have an Illinois attorney review for enforceability. Flat-fee review: $150-300.
