Terms of Service

Effective April 14, 2026

These terms govern your use of freezeandfizz.com and any services provided by Freeze and Fizz LLC ("we," "us," "our"). By using the site or booking a service, you agree to these terms.

1. Who can use the site

You must be at least 18 to book a service or enter into a catering contract. Under-18 users may browse with a parent's permission.

2. Bookings and quotes

• Booking requests submitted through this site are requests, not confirmations. We confirm availability within 24 hours.
• A booking is only locked in once (a) you receive a Square invoice, (b) you pay the non-refundable deposit, and (c) we send written confirmation.
• Quotes are valid for 7 days unless noted otherwise.
• Minimums, package terms, and add-on pricing are listed at catering.html and may be revised at any time — confirmed bookings are not affected.

3. Payment

• All payment is processed through Square. Accepted: credit/debit, ACH, Cash App Pay, Square Gift Cards.
• Deposit: 25% non-refundable to secure your date.
• Balance: due 7 days before the event.
• Late payments: if balance is not paid 7 days before, we reserve the right to release the date and retain the deposit.
• Taxes, service charges (22% on weddings), and travel fees (over 20 miles from LeRoy/Bloomington, $1.50/mile) apply as quoted.

4. Your event

• You're responsible for providing accurate event details: address, guest count, access, and any venue permits we need to follow.
• You're responsible for ensuring your venue allows a food truck or catering trailer on-site.
• We need access to a level, accessible space at least 15'×25' for the trailer. Indoor events = drop-off only.
• Generator or power hookup requirements will be confirmed in advance.

5. Cancellations, reschedules, and weather

See our full Cancellation & Weather Policy. Summary:

• 30+ days out: free reschedule (subject to availability).
• 14-30 days out: one free reschedule, deposit retained on outright cancel.
• Less than 14 days out: balance due, credit toward future event only.
• Severe weather: we work with you on a rain date; full refund only if we cancel for safety.

6. Intellectual property

The Freeze and Fizz name, logo, drink names (Blue Lagoon, Dirty Doctor, Campfire, Cotton Candy Cloud, etc.), recipes, photos, and site content are ours. Don't copy or reuse them without written permission.

7. Social media

By tagging us (@freezeandfizz) or using our hashtag, you grant us permission to repost your photos/videos to our accounts with credit. Let us know if you'd rather we not.

8. Warranty disclaimer

We serve our drinks with care, but we make no guarantee about suitability for specific medical, dietary, or allergen needs. Tell us about any allergies when you book; we'll do our best but cannot guarantee a fully allergen-free environment. The drinks contain common allergens: dairy (cream), soy (some syrups), coconut, caffeine (Lotus/Red Bull add-ons), and sugar.

9. Limitation of liability

To the maximum extent permitted by law, Freeze and Fizz LLC's total liability for any claim arising from our services will not exceed the amount you paid for the specific event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify and hold Freeze and Fizz LLC harmless from claims arising from (a) your breach of these terms, (b) misuse of our services, or (c) your guests' actions at your event.

11. Governing law

These terms are governed by Illinois law. Disputes will be resolved in McLean County, Illinois.

12. Changes

We may update these terms. The most current version is always posted here. Continued use of the site or services after an update means acceptance.
